Ltd. (“Vidysea”, “Company”, “we”, “us” or “our”) collects, receives, uses, processes, stores, shares, transfers, protects, retains and otherwise handles personal data in connection with its websites, applications, platforms, products, programmes and services.

This Policy applies to:

PathLynks is a proprietary product, platform and brand owned and operated by Vidysea Education Pvt. Ltd.

PathLynks is not a separate legal entity.

Any reference to PathLynks in this Policy means the PathLynks product or service provided by Vidysea Education Pvt. Ltd.

Unless expressly stated otherwise, all rights, obligations and responsibilities relating to PathLynks are those of Vidysea Education Pvt. Ltd.

Vidysea may develop, acquire, introduce or integrate additional products, applications, artificial-intelligence tools, platforms, educational services, career services, student-support services, institutional solutions or other business offerings in the future.

Unless a separate privacy notice expressly applies, this Privacy Policy shall also apply to such future Vidysea Services.

Where a future Service involves a materially different processing activity, Vidysea may provide a supplementary privacy notice and/or obtain additional consent where required by applicable law.

The information Vidysea collects depends upon the particular Service, the user's relationship with Vidysea and the purpose for which the information is required.

• student identification details;
• enrolment/application number; and

• grade/class;
• curriculum or board;
• academic subjects;
• marks and grades;
• academic records;
• examination scores;
• qualifications;
• certificates;
• academic interests;
• preferred subjects;
• preferred streams;
• educational goals;
• career interests;
• extracurricular activities;
• achievements;
• university preferences;

• preferred study destinations; and
• other education-related information.

5.3 PathLynks Assessment Information

Vidysea, for PathLynks, may process assessment responses and information relating to areas such as:

• interests;
• aptitude;
• strengths;
• abilities;
• personality-related preferences;
• learning preferences;
• multiple-intelligence-related indicators;
• values;
• motivations;
• career interests;
• subject and stream preferences;
• career readiness;
• resilience;
• developmental indicators; and
• other educational or career-guidance parameters.

Such information may be used to generate assessment reports, educational insights, recommendations, career pathways and student-development roadmaps.

PathLynks Assessments are intended for educational, developmental and career-guidance purposes and are not intended to constitute medical, psychiatric or clinical diagnosis or treatment.

5.4 Admission and Study-Abroad Information

Where relevant, we may process:

• university and course preferences;
• academic records;
• standardised-test scores;
• language-test scores;
• CV/resume;
• statements of purpose;
• letters of recommendation;
• application documents;
• admission status;
• passport-related information where necessary;
• visa-related information where necessary;
• scholarship information;
• financial information required for an application or requested service; and
• other supporting documents.

5.5 Parent and Guardian Information

We may collect:

• parent/guardian name;
• relationship with the child;
• mobile number;

• consent verification information;
• communication preferences;
• records relating to withdrawal of consent; and
• information reasonably necessary to verify parental/guardian authority.

• provide PathLynks assessments;
• generate assessment reports;
• provide educational and career guidance;
• personalise recommendations;
• provide counselling and mentoring;
• provide admission assistance;
• facilitate university and programme applications;
• provide study-abroad support;
• facilitate requested student-support services;
• provide training or skill-development programmes;
• administer school and institutional projects;
• operate government or CSR programmes;
• respond to enquiries;
• provide customer support;
• process payments;
• manage contractual relationships;
• send administrative and service communications;
• maintain security;
• investigate misuse or fraud;
• improve our Services;
• improve assessment methodologies;
• improve algorithms and AI-enabled systems;
• perform analytics;
• conduct research using appropriate safeguards;
• develop new features and Services;
• maintain legal, regulatory, accounting and audit records;
• exercise or defend legal claims; and
• comply with applicable law.

Certain Vidysea Services, including PathLynks, may use:

• artificial intelligence;
• machine-learning systems;
• algorithms;
• scoring models;
• recommendation engines;
• matching technologies; and
• other automated tools.

These systems may assist in generating recommendations concerning education, careers, subjects, streams, courses, universities, student development or related opportunities.

Automated outputs are intended to assist decision-making and should not be treated as guaranteed outcomes.

Users should consider such recommendations together with personal circumstances, academic performance, eligibility requirements, professional guidance and other relevant information.

Vidysea recognises that children require enhanced privacy protection.

Where applicable law requires verifiable parent or legal guardian consent before processing a child's personal data, Vidysea will obtain or facilitate such consent through an appropriate process.

This may include:

• direct parent consent;
• an electronic consent process;
• OTP or other verification;
• a parent account;
• school-facilitated consent where legally and contractually permitted; or
• another legally permissible verification mechanism.

Vidysea may maintain records of such consent.

Where required, the Services will remain restricted until required parent/guardian consent is completed.

Vidysea does not sell children's personal data.

Vidysea does not use children's responses, including PathLynks assessment responses, for targeted commercial advertising directed at the child.

Vidysea will not create advertising profiles from children's PathLynks assessment responses or use such responses for cross-site behavioural advertising. Further, no personal data of children will be used for tracking or behavioural monitoring of children.

Student information may, however, be analysed for legitimate educational purposes, including generating assessments, reports, educational recommendations and career guidance.

Where a school or educational institution provides information to Vidysea, the institution is expected to ensure that:

• it has appropriate authority to provide the information;
• applicable notices have been given;
• applicable permissions or consents have been obtained;
• information is provided for legitimate purposes;
• information is reasonably accurate;
• access is restricted to authorised personnel; and
• its personnel comply with applicable confidentiality and privacy requirements.

Vidysea may reasonably rely on representations, instructions and authorisations communicated by an authorised institutional representative unless Vidysea has reasonable grounds to believe otherwise.

Where Vidysea Services are delivered through a school or institution, authorised personnel may have access to agreed information, which may include:

• student registration status;
• consent status where relevant;
• assessment-completion status;
• PathLynks reports;
• educational or career insights;
• counselling information where authorised;
• engagement information; and
• aggregated programme information.

Institutions are responsible for ensuring that only appropriately authorised users access such information.

Subject to applicable law and the Service concerned, Vidysea may share information with:

1. Parents and Guardians
2. Where appropriate and authorised.
3. Schools and Educational Institutions
4. For programme delivery, assessments, reporting, counselling or administration.
5. Universities and Educational Institutions
6. Where a user requests admission or application assistance.
7. Counsellors and Mentors
8. Where necessary for educational or career support.
9. Business and Student-Service Partners

This may include providers of:

• education loans;
• financing;
• insurance;
• forex;
• accommodation;
• travel;
• visa assistance;
• admission support;
• test preparation; and
• other services specifically requested by a user.

10. Technology and Operational Providers

Including providers of:

• cloud infrastructure;
• hosting;
• authentication;
• databases;
• CRM systems;
• email;
• SMS;
• WhatsApp messaging;
• analytics;
• cybersecurity;
• payment processing;
• customer support;
• document management;
• video conferencing;
• backups; and
• other technology services.

11. Professional Advisers, including lawyers, accountants, auditors, insurers and consultants.

13. Where disclosure is required or permitted by applicable law, court order, government direction or regulatory requirement.

Certain Vidysea Services may involve independent third parties.

Third parties may have their own terms, eligibility criteria and privacy policies.

Vidysea is not responsible for the independent privacy practices of third parties merely because Vidysea has provided a referral, link or facilitation service, except to the extent responsibility cannot lawfully be excluded.

Vidysea uses reasonable technical, organisational and administrative measures designed to protect personal information.

These may include:

• access controls;
• role-based permissions;
• authentication;
• encryption where appropriate;
• backups;
• logging;
• security monitoring;
• restricted access;
• vendor controls; and
• security reviews.

No internet, electronic-storage or cloud system can guarantee absolute security.

Users are also responsible for protecting their credentials, devices, passwords and OTPs.

Where Vidysea becomes aware of a personal data breach, it may take appropriate steps to:

• investigate;
• contain;
• mitigate;
• remediate;
• preserve relevant evidence; and
• prevent recurrence.

Where notification is required under applicable law in force at the relevant time, Vidysea will provide required notifications in accordance with such law.

Vidysea may retain personal data for as long as reasonably necessary for:

• providing Services;
• maintaining assessment or programme records;
• fulfilling contracts;
• counselling and support;
• consent records;
• application processing;
• dispute resolution;
• security;
• fraud prevention;
• audit requirements;
• accounting and taxation;
• regulatory compliance;
• grievance handling; and
• establishment, exercise or defence of legal claims.

Where an institutional agreement specifies an appropriate retention requirement, that arrangement may also apply.

When information is no longer required, it can be deleted, erased, anonymised or de-identified subject to applicable law.

Information contained in secure backups may remain for a reasonable period pursuant to backup and continuity processes.

Vidysea may generate aggregated, statistical, anonymised or de-identified information for lawful purposes including:

• service improvement;
• assessment improvement;
• analytics;
• educational research;
• programme evaluation;
• benchmarking;
• product development;
• AI and algorithm improvement; and
• business planning.

Where information is no longer capable of identifying an individual and is not treated as personal data under applicable law, Vidysea may use such information for lawful analytical, research and product-development purposes.

Nothing in this clause gives Vidysea ownership of an individual's personal data.

Intellectual property developed by Vidysea from lawful analysis, including algorithms, methodologies, statistical models and product improvements, remains the property of Vidysea or its licensors.

Vidysea may use technology and service providers operating in India or other jurisdictions.

Where personal data is transferred or processed internationally, Vidysea will take measures reasonably required under applicable law.

Subject to applicable law, Vidysea may send eligible adult users, parents, schools and institutional users communications concerning:

• Vidysea Services;
• PathLynks;
• new products;
• educational opportunities;
• events;
• programmes;
• webinars;
• offers; and
• updates.

Recipients may opt out of non-essential promotional communications.

Transactional, administrative, authentication, security and Service-related messages may continue where necessary.

Non-marketing communications directly related to assessments and other Services opted for by students under 18 may be sent to those students.

Our websites and platforms may use cookies and similar technologies.

Details are contained in the separate Vidysea Cookie Policy available on www.vidysea.com.

Where appropriate, users may be offered cookie-management choices.

Subject to applicable law and applicable exemptions, individuals may have rights to:

• obtain information regarding processing;
• access information or obtain a summary where applicable;
• request correction;
• request completion or updating;
• request erasure where legally permissible;
• withdraw consent where processing is based on consent;
• raise a grievance;
• nominate another person where applicable; and
• exercise other rights provided under applicable law.

Vidysea may require reasonable identity or authority verification before processing a request.

Any individual who wishes to make any request, as aforesaid, may send such request on info@vidysea.com 

Where processing depends upon consent, consent may be withdrawn through the mechanism communicated by Vidysea or by contacting the relevant privacy/grievance contact.

Withdrawal may affect Vidysea's ability to continue providing a Service where processing of the relevant information is necessary for that Service.

Withdrawal does not automatically invalidate processing lawfully undertaken before withdrawal.

Information may continue to be retained where retention is required or permitted under applicable law. However, any other information or personal data, will be erased as soon as the consent is withdrawn.

Subject to applicable law, personal data may be disclosed or transferred as part of an actual or proposed:

• investment;
• financing;
• merger;
• acquisition;
• restructuring;
• amalgamation;
• transfer of business;
• sale of assets; or
• similar corporate transaction.

Appropriate legal and confidentiality safeguards will be applied where required.

Vidysea may update this Privacy Policy to reflect:

• new Services;
• future Vidysea products;
• changes in technology;
• new integrations;
• regulatory developments;
• changes in processing activities; or
• changes in business operations.

Material changes will be notified where required by applicable law.

The date at the beginning of the Policy identifies the latest version.

This Policy is intended to operate in accordance with applicable Indian privacy and data-protection requirements, including, to the extent applicable and in force from time to time, the:

Digital Personal Data Protection Act, 2023;

Digital Personal Data Protection Rules, 2025;

the Information Technology Act, 2000 and applicable rules, amendments, notifications and legally binding directions.

Where a mandatory requirement of applicable law conflicts with this Policy, the mandatory requirement will prevail to the extent of the conflict.
